Terms of Service

These terms of service apply to every offer from Quebec Advertising Agency and to every agreement concluded remotely between Quebec Advertising Agency and clients via advertising-agency.top. By requesting our services, you agree to these terms.

2. Definitions

• Client: the natural or legal person who engages our services for business purposes.
• Service Agreement: an agreement concluded between Quebec Advertising Agency and the client for the provision of marketing and advertising services.
• Cancellation Right: the client's ability to cancel the agreement within the specified notice period.

3. Applicability

These terms apply to every offer from Quebec Advertising Agency and to every service agreement concluded between Quebec Advertising Agency and clients. Deviations are only valid if confirmed in writing.

4. Services and information

• Our service offerings include a complete and accurate description of the offered marketing and advertising services. Obvious mistakes or errors do not bind Quebec Advertising Agency.
• Portfolio examples and case studies are indicative of our capabilities and may vary in detail.

5. Pricing

• All prices are in Canadian dollars and exclusive of applicable taxes unless otherwise stated.
• Quebec Advertising Agency may change prices. For existing agreements, the price at the time of agreement applies.

6. Agreement formation

The agreement is formed when the client accepts our proposal and meets the specified conditions (including successful payment arrangements), after which Quebec Advertising Agency electronically confirms receipt of the agreement.

7. Payment

• Payment is made via the payment methods offered on our website or as agreed in the service agreement. Quebec Advertising Agency may cancel agreements that are not (fully) paid.
• In case of non-payment, Quebec Advertising Agency is entitled to charge reasonable costs arising from collection.

8. Service delivery and execution

• Quebec Advertising Agency will handle and execute service agreements with the greatest possible care.
• Delivery times mentioned on the website are indicative. Exceeding these times does not give rise to compensation, unless otherwise agreed in writing.
• The risk of damage and/or loss rests with Quebec Advertising Agency until the service is delivered to the client, unless explicitly agreed otherwise.

9. Cancellation rights

• The client may cancel the agreement within 14 days after signing the service agreement without giving reasons.
• During the notice period, the client will handle any provided materials carefully and only use them to the extent necessary to assess the nature, characteristics and functionality.
• To exercise the cancellation right, the client can send an unambiguous declaration to contact@advertising-agency.top.
• The client returns any provided materials as soon as possible, but no later than 14 days after cancellation, in original condition and packaging, insofar as reasonably possible.
• In case of a valid and timely cancellation, Quebec Advertising Agency refunds all payments received from the client within 14 days after receipt of the returned materials or proof of return.

10. Exceptions to cancellation

The cancellation right is excluded for services that have been fully performed with the client's consent and that have begun execution, as well as for services that are clearly personalized or made according to the client's specifications.

11. Conformity and guarantee

• Quebec Advertising Agency warrants that the services comply with the agreement and the legal provisions and/or government regulations existing at the time of conclusion.
• If a service does not conform to the agreement, you must report this within a reasonable period after discovery via contact@advertising-agency.top. We will then provide you with an appropriate solution.

12. Liability

• Quebec Advertising Agency is not liable for indirect damage, consequential damage or lost profits. Our total liability is limited to the amount of the agreement to which the liability relates, unless mandatory law provides otherwise.
• Use services in accordance with any instructions provided and normal business practices.

13. Force majeure

Quebec Advertising Agency is not obliged to fulfill any obligation if it is prevented from doing so due to force majeure (e.g., technical failures, natural disasters, strikes, pandemics, government measures).

14. Personal data

We process personal data according to our privacy policy. There you can read which data we process, for what purposes and what your rights are.

15. Intellectual property

All (image) materials, texts, logos and layout on the website are protected by intellectual property rights and may not be used or reproduced without prior written permission.

16. Client content and reviews

Submitted reviews must be honest and genuine. Quebec Advertising Agency may moderate or remove reviews that are inappropriate or misleading.

17. Discount codes and promotions

Discount codes are personal or campaign-specific, not exchangeable for cash and only valid within the specified period and conditions.

18. Complaint procedure

Do you have a complaint? Report this as soon as possible via contact@advertising-agency.top with a clear description and agreement details. We respond within 3-5 business days. If you cannot resolve it with us, you can file a complaint with a supervisory authority.

19. Applicable law and forum

These terms and the agreement are governed by Canadian law, with due regard for mandatory consumer protection laws. Disputes may be submitted to the competent court in Quebec, without prejudice to legal rights.
